General terms and conditions of sale
1 – Purpose
These general terms and conditions of sale are intended to define the contractual relations between
– Funky Frames SA, located at Rue du Rhône 114 – 1204 Genève – Switzerland, a company registered in the Geneva commercial register under number CH-660.0.412.996-6 and publisher of the website www.funkyframes.com
– and any natural or legal person wishing to make a purchase via the website of Funky Frames SA, hereinafter referred to as the Customer.
The acquisition of goods through this site implies an unreserved acceptance by the Customer of these general terms and conditions of sale.
Funky Frames SA reserves the right to modify its general terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order placed by the Customer.
2 – Features of the goods offered
The products sold are those that appear in the catalogue published on the Funky Frames SA website. These products are available for sale within the limits of available stock. The features of the products as well as the photos visible on the site are given for information purposes only. The catalogue photographs are as accurate as possible but cannot guarantee a perfect resemblance to the product offered, particularly with regard to colours, and cannot have any contractual value. In the event that a product is unavailable, we will inform you as soon as possible.
3 – Prices
The prices shown in the catalogue are prices including all taxes in CHF or in EUR, depending on the customer's country of residence, and take into account the VAT applicable on the day of the order; any change in the rate may be passed on to the price of the products. Funky Frames SA reserves the right to modify its prices at any time and without notice, it being understood, however, that the price shown in the catalogue on the day of the order will be the only one applicable to the Customer. Funky Frames SA reserves the right not to deliver products whose displayed prices are erroneous, but undertakes nonetheless to inform its customers of a price difference and will offer alternative products. Funky Frames SA may run sales or promotions on its catalogue. These offers are only valid during the publication period on the site and cannot be claimed retroactively.
Vouchers or discounts distributed on the site or through partners or partner sites are exclusively valid under the conditions set out in the offer. These vouchers or discounts may only be used when placing the order and must be used in the field provided for this purpose. Under no circumstances may a voucher or discount be applied retroactively.
The Customer has the option of having their order delivered to their home: in this case, delivery charges will be added to the price of the products and will be displayed in the "cart" section. Delivery charges are calculated according to the weight and volume of the order as well as the delivery address.
4 – Orders and conclusion of the sale
The Customer who wishes to buy a product on the Funky Frames SA website must necessarily go through the various steps of the purchasing process (summary of the products chosen and placed in the cart, identification, choice of address and delivery method, and choice of payment method and settlement under the conditions provided). The confirmation of the order entails acceptance of these terms of sale, acknowledgement of having perfect knowledge of them, and waiver of the right to invoke one's own purchasing conditions or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out. Funky Frames SA will communicate the details of the recorded order by email.
The price of purchases made on the website www.funkyframes.com is due at the time of the order, without discount; payment is made by bank credit card (Visa or Mastercard) through Paypal, Stripe or any other means of payment accepted by the site at the time of the transaction.
Funky Frames SA does not have access to confidential information relating to the means of payment. The information entered is encrypted and managed securely by Paypal, Stripe or Twint, without Funky Frames SA or any third party being able to access it.

Delivery
5 – Deliveries
Deliveries are made to the delivery address indicated by the customer during the ordering process.
Funky Frames SA delivers to all countries served by its carrier but reserves the right to use other recognised providers. You can contact us for any special delivery request.
The amount of the shipping charges is indicated in the "cart" section and is subject to the Customer's approval before the validation of each order; the amount may vary according to the amount of your order, the weight of your parcel and/or the country of delivery.
- 5.1. Delivery charges
As a general rule, the shipping charges are partially covered by Funky Frames SA so as not to make the Customer bear the entire cost.
Deliveries to countries outside the European Union are made on a DDU basis (Delivery Duty Unpaid). The VAT of the place of production, namely France, may be deducted from the purchase price, but the recipient will have to pay the carrier the import taxes (VAT of the recipient country), as well as all the customs fees and duties relating to their order, which will be requested upon delivery.
- 5.2. Delivery times
Delivery times apply once the payment has been recorded by our accounting department, the parcel prepared and handed over to our delivery provider, for products in stock. As a general rule, for products that are not in stock, an approximate period of 15 working days must be added, corresponding to the average manufacturing time of Funky Frames artworks. Shipping takes place when all the items of the same order are in stock.
Delivery times are as follows for products in stock, namely:
– 5 working days to 7 working days for Switzerland and the European Union.
Funky Frames SA undertakes to inform the Customer of any delivery delay but cannot be held liable for any compensation on this account.
- 5.3. Delivery conditions
In the event of damage during transport, the reasoned complaint must be made within three days of delivery. The Customer must contact the Funky Frames SA Customer Service by email for any claim (info@funkyframes.com).
The claim must be completed with photos of the damage as well as of the damaged item(s).

6 – Warranties in case of defects and right of withdrawal
- 6.1 Commercial warranties
Funky Frames guarantees that the products comply with their expected use and do not present any defects or hidden flaws that would make them dangerous or unfit for their normal use. Funky Frames reminds the Customer that Funky Frames artworks are decorative objects only and are not toys. The illustration, and particularly the part outside the frame, are very fragile and any improper handling, notably by a child, could render it unusable.
- 6.2 Legal warranties
In the event of non-conformity of a product sold, the warranty of Funky Frames SA is limited to the return of the product and to the exchange or total or partial refund of the product, subject to compliance by the Customer with the conditions and deadlines indicated in the following paragraph.
Regardless of the existence of any non-conformity of the product, the Customer, a non-professional natural person, benefits from a withdrawal period of 14 days from the delivery of their order to notify Funky Frames SA of the return of the product for exchange or refund.
The artwork must be returned in its original packaging and must not have been hung or used. Returns of artworks with personalised annotations (special orders) are not possible.
The cost of returning orders is borne by the Customer.
The Customer must enclose with their shipment the product, the number of the order concerned by the return, the designation of the product(s) concerned by the return, as well as a request for exchange or refund.

The refund is made within 15 days of the registration of your return.
Orders made on the Funky Frames website cannot be returned or exchanged in partner stores.
7 – Warranties and liability
Funky Frames SA has taken all the usual precautions to ensure both the reliability of information and secure access to its website www.funkyframes.com.
However, Funky Frames SA cannot, under any circumstances, guarantee the total absence of material error, technical deficiency or other unintentional problems.
Likewise, no guarantee can be provided as to the compatibility of the site with your particular needs and uses.
Funky Frames SA cannot be held responsible for any damage related to the use of its site, and disclaims all responsibility for the information contained in other sites that may be linked to its own by a hyperlink or any other means.
8 – Intellectual property rights
All data of whatever nature, and in particular the texts, graphics, logos, icons, images, audio or video clips, trademarks, software, appearing on the Site, are necessarily protected by copyright, trademark law and all other intellectual property rights.
Funky Frames SA, in its capacity as publisher of the Site, grants the User a private, non-collective and non-exclusive right of use over the said content.
Under these conditions, the User undertakes not to reproduce, summarise, modify, alter or redistribute, without the prior express authorisation of the publisher, any text, title, application, software, logo, trademark, information or illustration, for any use other than strictly private, which excludes any representation for professional purposes or for redistribution in large numbers.
Likewise, the User undertakes not to copy all or part of the Site onto another site or an internal company network. Funky Frames SA cannot be held responsible for the uses made by Users of the data accessible on the Site.
Any creation of a hyperlink from a website to the Site must be subject to the express authorisation of Funky Frames SA.
9 – Protection of personal data
All customer data is processed in a strictly confidential manner and Funky Frames SA undertakes to respect the ethical rules issued by the ASVPC as well as the legislation in force, particularly with regard to data protection.
We only use your data for the proper handling of your order. After registration of your order, the email address provided will only be used to inform you of our new sales. You can unsubscribe at any time. Funky Frames SA undertakes not to disclose your personal data to third parties for commercial purposes.
To make your visit more interactive and to facilitate the use of certain functions, we use cookies. These are text files that are placed on your hard drive. Most of our cookies are deleted from your hard drive at the end of your visit (temporary / session cookies, etc.). The other cookies remaining on your computer will allow our site to recognise you on your next visit (permanent cookies). The use of the website www.funkyframes.com is authorised for private use only. Any commercial use, in particular for the purpose of reselling to third parties the products purchased on the site, is prohibited.
Any violation of this obligation will be penalised. Damages are reserved.
11 – Applicable law and jurisdiction
The relations between Funky Frames SA and the Customer are governed by Swiss law.
For any dispute relating to the relations between Funky Frames SA and the Customer, the place of jurisdiction is the location of the registered office of Funky Frames SA.
